Kings Partnership for Prevention Coalition (“KPFP”) operates www.kpfp.org, an Internet-based online information and communication service, located at www.kpfp.org, including all text, content, information, and data (collectively the “Content”) available therein (together the “Site”), and provides users with access to the Site subject to these terms and conditions (the “Agreement”). You may download and/or print a copy of the Content for your personal and non-commercial use only (the “Permitted Uses”), provided the Content is not modified in any way and all copyright and other proprietary notices are kept intact.

Claritas Data Use Restriction

If this Site contains Claritas demographic data, users may not download Claritas data. Users are expressly prohibited from using any portion of the Claritas Licensed Materials:
(a) in online direct marketing to individual consumers;
(b) as a factor in determining eligibility for health/life insurance coverage;
(c) for the purpose of taking “adverse action” against a consumer in the provision of healthcare/life insurance coverage or services; or
(d) as a factor in charging higher health/life insurance rates to consumers.

Children under the age of 13 are not permitted to submit information to this Site.

KPFP does not and cannot review all communications and materials posted or uploaded to the Site and is not responsible for the content of these communications and materials. Messages, advice, opinions, or other information contained in any discussion area should not be construed as professional advice or instruction.

Indemnification

Limitation of Liability

YOU AGREE THAT NONE OF THE KPFP PARTIES SHALL HAVE ANY LIABILITY TO YOU FOR DAMAGES ARISING OUT OF YOUR USE OF THE SITE. IN NO EVENT SHALL THE TOTAL LIABILITY OF THE KPFP PARTIES EXCEED ONE HUNDRED ($100) DOLLARS.

User Representations

You represent and warrant that you are at least 18 years of age and have the legal ability to enter into this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action concerning this Agreement shall be brought exclusively in a court of competent jurisdiction sitting in Kings County, California, United States.

Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
